1. Acceptance of Terms

By accessing or using this mobile application ("ECHOES," "the App," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

This app provides two distinct gaming experiences:

• ECHOES: An asynchronous multiplayer adventure game (rated 13+)
• FORMS: A strategic placement game (rated 18+)

2. Eligibility

2.1 Age Requirements

• ECHOES (13+): Users aged 13 and older can play ECHOES.
  Users under 13 require verifiable parental consent (COPPA compliance).
• FORMS (18+): Users must be 18 years or older to access FORMS.
  Age verification is enforced. Providing false age information is prohibited.

2.2 General Requirements

• You must have the legal capacity to enter into binding contracts
• You must be located in a jurisdiction where our services are legal
• You agree to comply with all applicable laws and regulations
• You must not be previously banned from our services

4. Account Registration

• You must provide accurate and complete information (email, date of birth, nickname)
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access
• One account per person - multiple accounts are prohibited
• We reserve the right to suspend or terminate accounts that violate these Terms
• Account deletion is permanent and cannot be reversed

5. Payments and Purchases

5.1 In-App Purchases

• All purchases are processed through Apple App Store or Google Play Store payment systems
• Prices are in USD unless otherwise stated (varies by region)
• All sales are final - refunds are handled per App Store policies
• We reserve the right to change prices at any time
• Subscriptions auto-renew unless cancelled 24 hours before the renewal date

5.2 Virtual Currency and Items

• Echo Tokens and cosmetic items have no real-world value
• Virtual items cannot be transferred, sold, or exchanged for real money
• We may modify, suspend, or discontinue any virtual items without liability
• Upon account termination, you forfeit all virtual items

6. User Conduct and Prohibited Activities

You agree NOT to:

• Cheat or exploit: Use bots, scripts, hacks, or exploits to gain unfair advantages
• Multiple accounts: Create multiple accounts or fake referrals
• Harassment: Harass, abuse, threaten, or harm other users
• Inappropriate content: Leave offensive, profane, or inappropriate notes/trails
• False age: Provide false age information to bypass restrictions
• Impersonation: Impersonate other users or staff
• Spam: Send unsolicited messages or content
• Reverse engineering: Attempt to access our source code or APIs
• Account sharing: Share your account credentials with others

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Suspected cheating or fraudulent activity
• Harassment or abusive behavior
• Providing false information (especially age)
• Legal or regulatory requirements
• Prolonged inactivity (6+ months)
• Any other reason at our sole discretion

Upon termination, you forfeit access to your account, purchased items, and progress.

9. Intellectual Property

All content, trademarks, logos, and intellectual property in ECHOES and FORMS are owned by us or our licensors. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our games
• Extract or scrape data from our services

User-Generated Content: By creating trails, notes, or other content, you grant us a worldwide, perpetual, royalty-free license to use, display, and distribute that content within the game.

10. Disclaimers and Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, or consequential damages
• Loss of progress, virtual items, or in-game currency
• Service interruptions, server downtime, or technical issues
• Actions or inactions of other players
• Any damages exceeding the amount you paid to us in the past 12 months

Some jurisdictions do not allow exclusions of certain warranties or limitations of liability, so the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless ECHOES, its developers, and affiliates from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your user-generated content

12. Changes to Service and Terms

We reserve the right to modify or discontinue the Service (or any part thereof) at any time, with or without notice.

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via in-app notification or email.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States, without regard to conflict of law principles.

Any disputes shall be resolved through good-faith negotiation. If a dispute cannot be resolved, it will be subject to the jurisdiction of courts in [Your Jurisdiction].
